Terms of Use & Purchase

Welcome to DavidBurch.com.

These Terms of Use & Purchase (“Terms”) explain the agreement between you and David Burch when you visit DavidBurch.com, create an account, purchase or access a course or membership, attend a live session, download materials, or otherwise use the products and services offered through this website.

Please read these Terms before making a purchase or participating in a program.

1. Who We Are

DavidBurch.com is operated by David Burch / DBA Energy Center, located in Clovis, New Mexico, United States.

Throughout these Terms, “DavidBurch.com,” “David Burch,” “we,” “us,” and “our” refer to the person or business operating DavidBurch.com.

Questions may be directed to:

Email: David@DavidBurch.com

DavidBurch.com provides educational materials and instruction related to subjects including Tai Chi, Qigong, mindful movement, breathing practices, meditation, relaxation, balance, walking, wellness, personal practice, and related educational topics.

2. Acceptance of These Terms

By using this website, creating an account, making a purchase, enrolling in a program, or participating in a class, you agree to these Terms and any policies incorporated into them.

Those policies include, where applicable:

  • the Membership, Cancellation & Refund Policy;
  • the Wellness, Movement & Safety Agreement;
  • the Privacy Policy;
  • the Cookie Policy.

If you do not agree with these Terms, please do not purchase or participate.

3. Educational and Wellness Services — Not Medical Care

DavidBurch.com provides education and wellness instruction.

Our content and instruction are not medical diagnosis, medical treatment, physical therapy, psychotherapy, or a substitute for care from an appropriately licensed healthcare professional.

David Burch may hold professional qualifications, certifications, licenses, or training in various wellness disciplines. Those qualifications do not turn general website content, courses, videos, books, memberships, or group classes into individualized medical care.

Nothing provided through DavidBurch.com establishes a physician-patient, therapist-patient, or other healthcare-provider relationship.

You should seek appropriate professional care for medical concerns and should not delay or discontinue treatment because of something you read, watch, or learn through DavidBurch.com.

Participation in movement, breathing, and wellness practices is also subject to our Wellness, Movement & Safety Agreement.

4. No Promised Medical or Personal Results

People respond differently to movement, relaxation, breathing, meditation, and wellness practices.

We do not promise that participation will diagnose, cure, treat, prevent, or eliminate any disease, injury, mental health condition, or other medical condition.

We also do not guarantee particular improvements in mobility, balance, sleep, stress, pain, mood, fitness, flexibility, strength, fall risk, or quality of life.

When we discuss potential benefits of Tai Chi, Qigong, breathing practices, mindfulness, or related activities, those statements are educational in nature and should be understood in the context in which they are presented.

Individual results vary.

5. Testimonials and Individual Experiences

From time to time, DavidBurch.com may share testimonials, student comments, stories, or descriptions of individual experiences.

These represent the experiences of particular individuals. They do not guarantee that another person will experience the same result.

A testimonial should not be interpreted as a medical claim simply because a participant describes a change in their own health, mobility, comfort, stress, sleep, or well-being.

We do not knowingly alter testimonials in a way that changes their meaning.

If a testimonial comes from someone who received compensation, free access, a discount, or another material benefit connected with the testimonial, we will disclose that relationship where required.

6. Eligibility

You must be legally capable of entering into an agreement to make purchases through DavidBurch.com.

Unless a particular program expressly states otherwise, our paid programs and memberships are intended for adults age 18 or older.

A parent or legal guardian who purchases or authorizes access for a minor is responsible for supervising that minor's participation.

7. Your Account

Some products require an account.

You are responsible for:

  • providing accurate information;
  • maintaining the confidentiality of your password;
  • keeping your contact information current;
  • notifying us if you believe your account has been accessed without authorization.

Your account is intended for your personal use unless the product description expressly permits another arrangement.

Please do not share login credentials, redistribute course materials, or provide unauthorized access to paid content.

We may suspend or terminate access if an account is being used fraudulently, unlawfully, abusively, or in material violation of these Terms.

Whenever reasonably possible, we will attempt to resolve ordinary account problems before terminating access.

8. Purchases and Prices

The price and material terms shown at checkout at the time of purchase are the terms that apply to that purchase.

Prices may change for future purchases.

A later price change does not retroactively change a completed purchase unless you separately agree to the change.

Taxes may be added where required by law.

Payments may be processed by third-party payment processors. We generally do not receive or store your complete payment-card information when payment information is handled directly by the payment processor.

9. Memberships and Recurring Payments

Some memberships renew automatically.

Before you purchase an automatically renewing membership, we will disclose the material renewal terms, including:

  • the price;
  • the billing frequency;
  • that the membership renews automatically;
  • how to cancel;
  • any special pricing conditions that apply.

By purchasing an automatically renewing membership, you authorize the applicable recurring charges until you cancel the membership.

Cancellation and refund terms are explained in the Membership, Cancellation & Refund Policy.

If you purchased a membership at a founding-member or other protected rate, the conditions for keeping that rate will be stated when you purchase.

10. Refunds

Refund eligibility is governed by the Membership, Cancellation & Refund Policy and by any product-specific terms clearly presented before purchase.

If a product-specific sales page offers a more generous refund policy than the general policy, the more generous policy applies to that purchase.

Nothing in our refund policy limits any refund, cancellation, or other consumer right that applicable law requires us to provide.

11. Live Classes

Live classes may be offered through Zoom or another third-party video platform.

Technology does not always work perfectly. A temporary internet outage, platform failure, equipment problem, or similar interruption does not necessarily constitute cancellation of a program.

When reasonably possible, we may respond to a disrupted session by providing a recording, replacement session, alternate access, or another reasonable solution.

If we permanently cancel a separately purchased event or program and do not provide a reasonable substitute, we will provide the refund or remedy described in the applicable purchase terms.

12. Recording of Live Sessions

Some live sessions may be recorded so that members or purchasers can watch a replay.

Our preference is to focus recordings on David and the instructional content rather than on participants.

If a session may be recorded, participants will be informed.

If you do not want your image or voice included in a recording, keep your camera and microphone off unless you have confirmed that recording has stopped.

If participant contributions are intentionally featured in material intended for public distribution, separate permission may be requested when appropriate.

Private questions involving personal or sensitive information should not be submitted during a recorded portion of a group session.

13. Intellectual Property

Unless otherwise stated, DavidBurch.com content is owned by David Burch or used with permission.

This includes, among other things:

  • videos;
  • course lessons;
  • recordings;
  • written lessons;
  • handouts;
  • worksheets;
  • graphics;
  • photographs;
  • audio;
  • practice sequences;
  • downloadable files;
  • website copy;
  • other original instructional materials.

Purchasing a product gives you a limited, personal, non-exclusive, non-transferable license to use that product for your own personal educational purposes.

It does not transfer ownership of the content to you.

Unless we give written permission, you may not:

  • reproduce or redistribute paid materials;
  • upload course content to another website or service;
  • share paid recordings with people who did not purchase access;
  • resell or sublicense materials;
  • remove copyright or ownership notices;
  • use substantial portions of our materials to create a competing commercial product;
  • publicly broadcast paid classes or recordings.

You may, of course, use what you learn in your own life and personal practice.

If you are an instructor and would like permission to use specific teaching materials professionally, please contact us.

14. Personal Use and Teaching

Tai Chi, Qigong, breathing methods, meditation, and many traditional movements are not owned by DavidBurch.com merely because we teach them.

Our intellectual-property rights apply to our original expression, recordings, written materials, program organization, graphics, branding, and other protectable content—not to traditional arts themselves.

Nothing in these Terms is intended to prevent you from practicing or teaching traditional Tai Chi, Qigong, meditation, breathing, or movement methods that you have legitimately learned.

15. Community Conduct

If DavidBurch.com offers comments, discussions, community areas, group classes, or other participant interaction, please treat others respectfully.

You may not use our services to:

  • harass or threaten another person;
  • discriminate against or deliberately demean participants;
  • post unlawful material;
  • impersonate another person;
  • distribute malware or malicious code;
  • solicit participants through deceptive means;
  • collect other members' personal information without permission;
  • substantially interfere with another person's ability to participate.

We may remove content or restrict participation when reasonably necessary to protect participants or the service.

16. Information You Share

You remain responsible for information you voluntarily share in a class, community, email, comment, or other communication.

Please use particular care with medical, financial, identifying, or otherwise sensitive information.

Group classes and community spaces should not be considered confidential healthcare environments.

Our treatment of personal information is described more fully in our Privacy Policy.

17. Third-Party Services and Links

DavidBurch.com may rely on third-party services for functions such as:

  • website hosting;
  • course delivery;
  • payment processing;
  • email delivery;
  • video conferencing;
  • analytics;
  • embedded media.

We may also link to websites or resources operated by others.

We do not control every aspect of third-party services and are not responsible for their independent content, policies, security practices, availability, or actions.

Use of a third-party service may also be subject to that provider's terms and privacy policy.

18. Service Availability

We work to keep our website and services available, but uninterrupted access cannot be guaranteed.

We may occasionally need to:

  • perform maintenance;
  • update content;
  • replace technology;
  • change class schedules;
  • modify features;
  • retire outdated products;
  • respond to circumstances beyond our reasonable control.

If a material change substantially affects a paid product, we will make a reasonable effort to provide an appropriate substitute, continued access, account credit, refund, or other fair remedy based on the circumstances.

19. Changes to Programs

Tai Chi, Qigong, wellness education, technology, and our own teaching continue to evolve.

We may revise course materials, lesson order, exercises, instructors, technology, scheduling, or supporting resources when we believe doing so improves or maintains a program.

We will not intentionally substitute something materially different for a paid product without providing a reasonable remedy.

20. Disclaimer of Warranties

To the fullest extent permitted by applicable law, this website and its content are provided on an “as available” basis.

We do not guarantee that:

  • the website will always be uninterrupted or error-free;
  • every device or browser will be compatible;
  • participation will produce a particular result;
  • every practice will be appropriate for every person.

Nothing in this section excludes warranties or consumer protections that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, David Burch and [LEGAL BUSINESS NAME, IF APPLICABLE] will not be liable for indirect, incidental, special, exemplary, or consequential economic damages arising from use of the website or digital services when such damages were not reasonably foreseeable.

For claims arising from the purchase of a digital product or service, any contractual limitation of monetary liability will apply only to the extent permitted by applicable law.

Nothing in these Terms is intended to waive liability or legal rights that cannot lawfully be waived, including duties or remedies that applicable law makes non-waivable.

The risks associated with voluntary participation in movement and wellness activities are addressed separately in the Wellness, Movement & Safety Agreement.

22. Your Responsibility for Misuse

You are responsible for losses or claims caused by your own unlawful conduct, intentional misuse of our services, infringement of another person's rights, or material violation of these Terms.

This provision does not require you to compensate us for losses caused by our own conduct where applicable law places responsibility on us.

23. Copyright Concerns

If you believe material on DavidBurch.com infringes your copyright or other intellectual-property rights, contact us at [BUSINESS EMAIL] with enough information for us to identify and evaluate the material.

24. Governing Law

These Terms are governed by the laws of the State of New Mexico and applicable federal law, without regard to rules concerning conflicts of laws.

Any dispute that must be resolved in court should be brought in a court of competent jurisdiction in New Mexico where legally permissible.

If the consumer-protection law of another jurisdiction gives you rights that cannot legally be waived or replaced by New Mexico law, those mandatory rights remain in effect.

Nothing in these Terms prevents either party from using a small-claims court when that court has jurisdiction.

25. Resolving Problems First

If you have a problem with a purchase or service, please contact us before assuming the problem cannot be resolved.

Email: [BUSINESS EMAIL]

Our goal is to deal with legitimate customer problems fairly and promptly.

This informal resolution provision does not eliminate your legal rights or impose a mandatory arbitration requirement.

26. Changes to These Terms

We may update these Terms as our services, technology, or legal obligations change.

The current version will be posted on DavidBurch.com with its effective or “last updated” date.

Material changes will apply prospectively unless applicable law allows or requires otherwise.

If a material change affects an existing recurring membership, we will provide notice when required by law.

27. Severability

If a court determines that one provision of these Terms is invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

28. No Waiver

If we do not enforce a provision on one occasion, that does not mean we permanently waive the right to enforce it later.

29. Entire Agreement

These Terms, together with the policies and purchase terms incorporated into them, constitute the agreement governing your use of the applicable DavidBurch.com product or service.

Product-specific terms presented at checkout are also part of that agreement.

If a specific written offer conflicts with these general Terms, the more specific provision controls for that purchase.

Membership, Cancellation & Refund Policy

I want you to stay because the practice is useful to you—not because cancelling is difficult.

This policy explains how memberships, renewals, cancellations, and refunds work at DavidBurch.com.

The Short Version

  • You will be shown the price before you purchase.
  • If a membership automatically renews, we will clearly tell you before you purchase.
  • You may cancel an automatically renewing membership before your next renewal.
  • Cancelling stops future renewals; it normally does not immediately remove access you have already paid for.
  • We will not intentionally make you call, negotiate, or sit through a sales pitch simply to stop a recurring charge.
  • If you have a billing problem, contact us. We would rather solve the problem than hide behind a policy.

The complete terms follow.

Memberships

1. Annual Memberships

An annual membership provides access for the membership period shown when you purchase.

If the membership automatically renews, your payment method will be charged again at the beginning of the next annual membership period unless you cancel before renewal.

Your checkout page will identify:

  • the amount charged today;
  • whether the membership renews automatically;
  • the renewal frequency;
  • the expected renewal price or applicable pricing rule;
  • how to cancel.

2. Founding Membership

If you purchased a DavidBurch.com Founding Membership at $99 per year, that rate remains your annual membership rate for as long as the membership remains continuously active, subject to the original offer terms.

If you cancel the Founding Membership and later decide to return, the original founding rate is not guaranteed. You may need to rejoin at the price then being offered.

We will not raise a protected founding-member rate merely because the standard membership price later increases unless the original offer expressly allowed such a change or you affirmatively agree to new terms.

3. Automatic Renewal

When you purchase an automatically renewing membership, you authorize us and our payment processor to charge the applicable membership fee at each renewal until you cancel.

Automatic renewal will be disclosed before you submit payment.

Silence after purchase is not treated as consent to a new or materially different charge that was not part of the agreement you originally accepted.

4. Renewal Reminders

For annual memberships, our standard practice is to provide advance notice of an upcoming renewal.

The notice should identify:

  • the upcoming renewal date;
  • the amount expected to be charged;
  • the membership being renewed;
  • how to cancel.

Where applicable law imposes a particular notice period or method, we intend to follow that requirement.

Please keep the email address associated with your account current.

Failure of an email provider to deliver or display an otherwise properly sent courtesy reminder does not by itself cancel a renewal that you previously authorized, except where applicable law provides otherwise.

Cancellation

5. You May Cancel Before Renewal

You may cancel an automatically renewing membership at any time before the next renewal charge.

Cancellation stops future automatic renewal.

Unless otherwise stated, cancelling does not immediately terminate a membership period you have already paid for. You may continue using the membership through the end of the current paid period.

6. How to Cancel

You may cancel using the cancellation controls available in your account.

If those controls are unavailable, confusing, or do not work, you may cancel by emailing:

Please use the Support page on DavidBurch.com to contact us.

Include enough information for us to identify the membership, such as the name and email address associated with your account.

We will not require you to telephone us solely because you enrolled online.

A reasonable written cancellation request will be honored even if a technical problem prevents you from using the normal account cancellation process.

7. Cancellation Confirmation

After a successful cancellation, you should receive confirmation through the website, platform, or email.

Please keep that confirmation for your records.

If you believe you cancelled but receive another charge, contact us promptly so we can investigate.

Refunds

8. Annual Membership — Initial Purchase

If you purchase an annual membership and decide it is not a good fit, you may request a refund within 14 calendar days of the initial purchase.

If a refund is issued, membership access may end when the refund is processed.

This 14-day policy is our general customer-service policy. A particular offer may provide a longer refund period.

9. Annual Membership — Renewal

If an annual membership renews and you did not intend to continue it, contact us within 14 calendar days after the renewal charge.

We will ordinarily refund an unintended annual renewal requested during that period and cancel future renewals.

Access may end when the renewal refund is processed.

This policy is intended to prevent a forgotten renewal from turning into a bad customer experience.

Nothing in this section reduces any greater refund or cancellation right provided by applicable law.

10. Self-Paced Online Courses

Unless the sales page states otherwise, paid self-paced courses purchased directly through DavidBurch.com may be refunded within 14 calendar days of purchase if you determine that the course is not right for you.

Upon refund, access to the paid course may be removed.

If a course is sold with a longer satisfaction guarantee, the longer guarantee controls.

11. Digital Downloads

Because downloadable products may be delivered immediately and cannot literally be returned, standalone digital downloads are normally non-refundable after successful delivery unless:

  • the file is defective;
  • you received the wrong product;
  • you were charged more than once for the same purchase;
  • the product was materially misrepresented;
  • applicable law requires a refund.

If there is a problem with a download, contact us. We will first try to replace or correct the file.

12. Books Purchased Through Other Retailers

Books purchased through Amazon or another third-party retailer are subject to that retailer's payment, return, and refund policies.

DavidBurch.com cannot directly refund a purchase for which we did not process the payment.

13. Live Workshops or One-Time Events

If a live workshop or special event is sold separately from a membership, the cancellation terms displayed on that event's sales page apply.

If no special policy is displayed:

  • you may request a refund before the event begins;
  • if we cancel the event without providing a reasonable replacement or rescheduled session, you will be offered a refund.

Once a live event has occurred and access has been provided, refunds are normally considered based on the circumstances rather than guaranteed.

14. Technical Problems

Please tell us when a technical problem prevents you from accessing something you purchased.

We will normally try to correct the problem by:

  • restoring access;
  • providing an alternate link;
  • replacing a file;
  • helping resolve an account issue;
  • offering another reasonable solution.

If we cannot provide the product or service you purchased within a reasonable period, an appropriate refund may be issued.

15. Duplicate or Incorrect Charges

If we or our payment processor charged you twice for the same transaction or charged an incorrect amount, contact us.

Verified billing errors will be corrected.

16. Chargebacks and Payment Disputes

You have the right to dispute a charge with your financial institution when appropriate.

However, many billing problems can be resolved faster by contacting us first.

A chargeback does not create a waiver of either party's legal rights, but access associated with a payment that has been reversed may be suspended while the matter is being resolved.

17. Refund Method

Approved refunds are generally returned to the original payment method.

The time required for the credit to appear is controlled in part by the payment processor, card issuer, or financial institution.

18. Abuse or Fraud

We reserve the right to deny discretionary refunds in cases involving fraud or clear abuse of a refund policy.

This provision does not eliminate rights provided by applicable consumer law.

Price Changes

19. Changes to Standard Membership Pricing

We may change the price offered to new members.

For existing members whose renewal rate is not contractually protected, we will provide notice before a material price increase takes effect where required by law.

You will have the opportunity to cancel before being charged a materially increased recurring price.

20. Founding Rates

A rate expressly sold as a lifetime or continuously active founding-member rate will be treated according to the terms of that offer.

For the current $99/year Founding Membership, maintaining continuous membership is the condition for maintaining that founding rate.

Our Principle

A recurring membership should be a continuing choice.

We do not want to retain members by making cancellation obscure or unnecessarily difficult.

If the website or membership platform does not behave the way this policy says it should, contact us so we can address the problem.

Wellness, Movement & Safety Agreement

DavidBurch.com offers Tai Chi, Qigong, breathing practices, mindful movement, meditation, walking practices, relaxation exercises, self-massage, and related wellness education.

These practices are intended to meet you where you are.

You are always free to make a movement smaller, move more slowly, practice seated, rest, skip an exercise, or stop.

Please read this agreement before participating.

1. Educational Wellness Practice — Not Medical Treatment

DavidBurch.com provides education and wellness instruction.

Participation does not constitute medical diagnosis, medical treatment, physical therapy, psychotherapy, rehabilitation, or individualized healthcare.

Information provided during a class, video, course, book, membership, email, or other educational setting should not replace advice from an appropriately licensed healthcare professional who knows your individual circumstances.

Do not delay or discontinue necessary medical care because of something taught through DavidBurch.com.

2. You Know Your Body Better Than I Do

In a video or group class, I cannot fully evaluate your medical history, physical environment, balance, medications, injuries, cardiovascular condition, neurological condition, pain, fatigue, or other individual circumstances.

You are therefore responsible for deciding whether and how to participate.

Instructions are invitations, not commands.

If an instruction does not feel appropriate for you, modify it or do not do it.

3. When to Speak With a Healthcare Professional

Consider seeking appropriate professional guidance before beginning or substantially changing an exercise or breathing practice if you:

  • have a significant medical condition;
  • have recently had surgery;
  • have experienced recent falls;
  • have significant balance problems;
  • have an injury that affects movement;
  • have unexplained dizziness or fainting;
  • have significant heart or lung disease;
  • have uncontrolled blood pressure;
  • are pregnant and uncertain whether a practice is appropriate;
  • have been instructed to restrict physical activity;
  • are taking medication that significantly affects balance, heart rate, blood pressure, alertness, or exercise tolerance;
  • have another condition that makes you unsure whether participation is appropriate.

This list is not exhaustive.

When in doubt, seek individualized advice from an appropriately qualified professional.

4. Practice Where You Are Today

Your capacity can change from day to day.

A movement that felt easy yesterday may not be appropriate today.

You are encouraged to:

  • move within a comfortable range;
  • reduce the size of movements when appropriate;
  • slow down;
  • use a chair or stable support;
  • practice seated;
  • take breaks;
  • omit movements;
  • adjust your stance;
  • reduce repetitions;
  • stop whenever you need to.

There is no prize for pushing through warning signs.

5. Pain Is Not the Goal

Some movement may produce ordinary sensations associated with effort, stretching, unfamiliar coordination, or muscular use.

Sharp pain, significant pain, or a sensation that feels unsafe is a reason to stop or modify the activity.

Do not deliberately push through pain simply to complete an exercise.

6. Stop for Concerning Symptoms

Stop the activity and seek appropriate assistance if you experience symptoms such as:

  • chest pain or pressure;
  • fainting or near-fainting;
  • severe or unusual shortness of breath;
  • sudden weakness;
  • sudden numbness;
  • sudden confusion;
  • severe dizziness;
  • loss of balance that feels unsafe;
  • a new severe headache;
  • sudden vision changes;
  • an irregular or racing heartbeat accompanied by distress;
  • significant new pain;
  • another symptom that makes you believe continuing may be unsafe.

If you believe you are experiencing a medical emergency, contact emergency services.

DavidBurch.com is not an emergency medical service.

7. Balance and Fall Safety

Tai Chi and Qigong may involve standing, shifting weight, stepping, turning, coordination, or periods of single-leg loading.

Those activities can create a risk of losing balance or falling.

Before practicing:

  • make sure you have enough clear space;
  • remove obvious trip hazards when possible;
  • wear appropriate footwear or practice on an appropriate surface;
  • keep pets, cords, furniture, rugs, and other obstacles in mind;
  • use a stable chair, counter, wall, railing, or other appropriate support when needed;
  • choose seated practice when standing practice does not feel safe.

Do not use a rolling, folding, unstable, or otherwise unsuitable chair as balance support.

You do not need to reproduce the instructor's range of motion or balance challenge.

8. Seated Practice Is Real Practice

When seated variations are offered, they are not a lesser form of participation.

Practice seated whenever that is the safer or more useful choice for you.

If you are unable to safely perform a standing movement, do not attempt it merely because the instructor is standing.

9. Breathing Practices

Breathing practices can affect sensations of relaxation, arousal, lightheadedness, and respiratory comfort.

Unless a specific practice is clearly explained otherwise, do not strain, force the breath, or compete to breathe more deeply than is comfortable.

If a breathing exercise makes you dizzy, distressed, numb, unusually short of breath, or otherwise uncomfortable: stop the exercise and return to ordinary breathing.

If standing, sit or otherwise make yourself safe before continuing.

People with respiratory, cardiovascular, neurological, panic-related, or other relevant conditions should seek individualized professional guidance when appropriate.

DavidBurch.com does not encourage extreme hyperventilation, prolonged breath deprivation, or competitive breath-holding as part of ordinary wellness practice.

10. Meditation, Relaxation and Internal Awareness

Meditation, relaxation, imagery, and increased attention to internal sensations can occasionally bring up uncomfortable thoughts, memories, feelings, or bodily sensations.

You are free to:

  • open your eyes;
  • change position;
  • orient to your surroundings;
  • stop the exercise;
  • seek appropriate professional support.

These practices are not substitutes for mental-health treatment.

11. Self-Massage and Acupressure

Some programs may include gentle self-massage, tapping, rubbing, or pressure applied by the participant to their own body.

Use comfortable pressure.

Do not deliberately press into an area that is injured, infected, acutely inflamed, recently operated on, unusually painful, or medically restricted.

Unless expressly stated otherwise, DavidBurch.com instruction does not involve inserting acupuncture needles or teaching participants to perform invasive procedures.

12. Your Physical Environment Matters

Online instruction takes place in an environment I cannot inspect.

Before participating, please consider whether your surroundings are suitable.

Factors may include:

  • available floor space;
  • surface traction;
  • furniture;
  • pets;
  • cords;
  • rugs;
  • lighting;
  • footwear;
  • temperature;
  • access to support;
  • other people moving through the space.

If the environment is not safe for a particular movement, change the movement or choose another location.

13. Live Online Classes

During a live online class, the instructor's ability to observe you may be limited.

The instructor may not notice:

  • unsafe alignment;
  • loss of balance;
  • signs of illness;
  • pain;
  • fatigue;
  • environmental hazards;
  • other circumstances that would be obvious in an individual, in-person assessment.

Do not assume that silence from the instructor means a movement is medically or physically appropriate for you.

14. Inherent Risks of Voluntary Participation

Physical and wellness activities involve some unavoidable risk.

Depending on the practice and the participant, foreseeable risks may include:

  • muscle soreness;
  • strains or sprains;
  • aggravation of an existing condition;
  • dizziness or lightheadedness;
  • loss of balance;
  • falls;
  • collision with objects;
  • fatigue;
  • emotional discomfort;
  • other injuries associated with voluntary physical activity.

Serious injury is uncommon in appropriately modified gentle practice, but no physical activity can be represented as entirely risk-free.

By voluntarily participating, you acknowledge these inherent risks and accept responsibility for choosing the level and manner of participation that is appropriate for you.

15. This Is Not a Contest

You are not expected to:

  • match the instructor's depth of stance;
  • achieve the instructor's range of motion;
  • balance as long as someone else;
  • breathe at someone else's pace;
  • complete every repetition;
  • practice through fatigue;
  • perform a movement simply because another participant can perform it.

Your practice belongs to you.

16. Results Vary

People practice Tai Chi, Qigong, breathing, meditation, and related methods for many reasons.

Some people report meaningful changes in areas such as relaxation, confidence, mobility, balance, stress, comfort, sleep, or general well-being.

No particular outcome is guaranteed.

A personal testimonial or instructor experience does not guarantee the same result for you.

17. Personal Responsibility

By participating, you agree to take reasonable responsibility for your own participation, including:

  • selecting appropriate modifications;
  • stopping when necessary;
  • seeking professional medical guidance when appropriate;
  • maintaining a reasonably safe practice environment;
  • following emergency medical advice when needed.

You also agree not to intentionally use the instruction in a way that is clearly contrary to the safety guidance provided.

18. Assumption of Inherent Risk

By choosing to participate, you knowingly accept the ordinary and inherent risks associated with the activities you voluntarily perform.

This acknowledgment is intended to confirm informed participation.

It is not intended to waive any legal right or duty that applicable law does not permit to be waived.

Nothing in this agreement releases David Burch or [LEGAL BUSINESS NAME, IF APPLICABLE] from responsibility in circumstances where applicable law prohibits such a release.

19. Recorded and On-Demand Content

Safety instructions given in a recording can only address general circumstances.

A recording cannot know whether your condition has changed since the video was made or since the last time you practiced.

Approach each recorded practice based on how you are doing today.

20. Accessibility and Adaptation

I want these practices to be usable by as many people as reasonably possible.

Many practices can be adapted by:

21. Questions During Class

You are welcome to ask general questions about a practice.

However, a group instructor cannot diagnose an injury or determine whether a specific symptom is medically safe through a class chat, email exchange, or brief conversation.

Questions requiring medical assessment should be directed to an appropriately qualified healthcare professional.
